Terms and conditions of purchase

GENERAL INFORMATION

In accordance with article 10 of Law 34/2002, of July 11, on information society services and electronic commerce (LSSI), it is hereby stated that CHILL & BUY SL with CIF B 27.856.814 and registered office at Camiño Toutizo 22 bjo, 36214 Vigo (Pontevedra) is the owner of this domain www.chillandbuy.es. These terms and conditions, together with their acceptance in the purchase confirmation, constitute the contract between you and CHILL & BUY SL.

PURCHASE PROCESS

In accordance with Article 27 of Law 34/2002, of July 11, on information society services and electronic commerce (LSSI), the various procedures for entering into an online contract are set forth below. Pursuant to Article 27.1.b of the aforementioned Law, CHILL & BUY SL will archive the electronic document formalizing the contract, which will be accessible to the user upon request. CHILL & BUY SL will send a copy to the customer once the purchase process is complete, also attaching a copy of this document (general purchase conditions, withdrawal document, and, if the product has been paid for before leaving our facilities, the purchase invoice).

GENERALITIES

As a general rule, placing an order with CHILL & BUY SL implies acceptance of the general terms and conditions of sale reflected in this document. The Customer declares, under their own responsibility, that they have read and understood these terms and conditions of sale and accept them. No stipulations made by the Customer may differ from those of CHILL & BUY SL unless expressly accepted by our online sales department.

ORDER METHODS

Customers have several ways to place their orders: Online, at: www.chillandbuy.es. By email, at: chillandbuy@chillandbuy.es. By WhatsApp, at: 886 905 686. PRICES: All prices shown on the product sheet include 21% VAT. Prices are expressed in euros (€). The applicable price will be the one shown at the time of purchase. Published prices are valid until the end of the offer. The company reserves the right to change product prices without prior notice.

PAYMENT METHODS

CHILL & BUY SL offers the following payment methods:

1. BANK TRANSFER OR ACCOUNT DEPOSIT: When choosing this payment method, you will need to make a bank deposit, including your first and last name, and order number. The merchandise will not be shipped until the bank confirms the transfer. You can also send us an email with a copy of the bank deposit to expedite the shipping process. 2. CREDIT CARD: The purchase amount will be charged upon order confirmation. To ensure transaction security, the bank details entered are encrypted and transmitted directly to the bank's servers and verified with the issuing bank to prevent fraud and unauthorized use.

3. PAYPAL: CHILL & BUY SL receives payment notification immediately, unlike other methods, which take several days for the customer to confirm payment. This payment method does not increase the price of the item. PayPal allows direct payment without sharing financial information online. PayPal automatically encrypts sensitive data using the best technologies available.

DELIVERY TIMES

CHILL & BUY SL does not ship any product or order until we verify payment of the invoice. Shipments will be accompanied by your invoice or order confirmation (electronic document). Shipping times may vary depending on the delivery address, time of purchase, and item availability, but typically do not exceed 72 hours from verification of payment. CHILL & BUY SL is not responsible for the delivery of the merchandise to the address or for any delays in the delivery time. If the customer notices any anomaly in the delivered package, please note your complaint on the delivery note and indicate "pending verification" on the delivery note. Then, inform us of the anomaly as soon as possible, within 24 hours of delivery (Article 952.2 of the Commercial Code). CHILL & BUY SL may change its delivery time conditions at any time and without prior notice. Please visit this section frequently.

SHIPPING COSTS

Standard Shipping: All our shipments are completely free within the Iberian Peninsula. We want you to enjoy our garments without worrying about additional costs. Canary Islands and Rest of Europe: For our customers in the Canary Islands and the rest of Europe, shipping has a fixed cost of €9. Express Shipping: Do you need your order urgently? We offer a 48-hour express shipping option for an additional cost of €6.95, available only within the Iberian Peninsula.

RETURNS

We are committed to your satisfaction. If for any reason you wish to return an item, we make it easy: Notification: Send us an email within 15 days of receiving your order, stating the reasons for the return. Free Pickup: We will pick up the item from your home at no cost to you. Product Condition: It is important that the item is returned in its original condition, unworn, with tags attached, and in optimal condition. Refund: Once we receive and inspect the item, and verify that it is in optimal condition, we will issue a full refund within a maximum of 14 days. Important Note: Original shipping costs are non-refundable for international returns, including the Canary Islands and the rest of Europe.

RIGHT OF WITHDRAWAL

CHILL & BUY SL defines a return as the return of the product or products purchased by the customer and their subsequent refund (Right of Withdrawal). CHILL & BUY SL defines an exchange as the replacement of the product with an identical or different one. Customers have 14 business days (in compliance with Chapter II of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws in its article 71.1) from receipt of the merchandise to process the return. Once the material has been checked and everything is correct, the total amount paid by the customer will be refunded within a period of no more than 5 days (including shipping costs). Return costs when exercising the right of withdrawal are borne by the customer. Returns and cancellations of personalized products are not accepted, except for defective products, those with defects, or an error on our part during customization.

EXCHANGE POLICY

CHILL & BUY SL defines an exchange as the replacement of a product with any other. Customers have 30 calendar days from receipt of the merchandise to make any exchanges. During the holiday season, from November 15th to January 6th, the deadline is extended until January 10th. The procedure for exchanges is as follows: Send an email to chillandbuy@chillandbuy.es. You must inform us that it is an exchange, the date of purchase, order number, and the reason for the exchange or return. You must indicate the product(s) you wish to receive to determine their current availability. CHILL & BUY SL will assess whether it is within the established legal deadlines or the commercial guarantee that CHILL & BUY SL provides to its customers. The package must contain the original packaging, labels, user manuals, and warranties. The product must be unused, in its original packaging, and with all its accessories and accompanying documentation. Once the package arrives, we will check that the product is free of any damage and has not been used. If the product is in perfect condition, we will exchange it immediately. If, on the other hand, we detect any anomaly, the customer will be informed of this incident. CHILL & BUY SL will refund the initial shipping costs, and the customer will be responsible for the cost of shipping the product from their home to the store (return costs). CHILL & BUY SL does not accept returns with postage due. Exchanges of personalized products are not accepted, except for defective products, those with defects, or due to a mistake on our part during customization.

WARRANTY

According to current regulations (Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws), all new products have a two-year warranty, unless the manufacturer grants a longer period, which can be seen in the product information sheet. CHILL & BUY SL is responsible for supporting the warranty. The warranty for purchased products will be your purchase invoice. The warranty period begins on the date of delivery of the product. Defects or damage that may arise from improper handling of products and materials or wear and tear caused by normal use are not included in the warranty. The warranty documentation included by the manufacturers is mandatory for the buyer to read. The warranty documents may include or exclude limitations on the product's warranty coverage. Any incident or anomaly during the warranty period must be reported by email to chillandbuy@chillandbuy.es.

TERMINATION OF THE CONTRACT

In accordance with Article 60.2.d of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI), the procedures available to the consumer to terminate the contract are set forth.

A customer who has confirmed the order during the purchasing process may cancel it in the following situations:

A) You decide to cancel your purchase after purchase: You must notify us before the goods leave our facilities. If you have already paid for the product, you must notify us as soon as possible. B) You decide to cancel your purchase while the goods have already been shipped. You must exercise your right of withdrawal upon receipt of the product. C) CHILL & BUY SL does not have the product. We may not have the product at the time of purchase; we will try to obtain it as quickly as possible, or you may choose another product. The customer may choose to cancel the order.

USER REGISTRATION

Formalizing any commercial relationship with CHILL & BUY SL through this website requires prior registration of the customer or user. By submitting the registration form, the customer acknowledges and affirms that the data provided is their own, true, and accurate. As a registered user, they declare that they are of legal age and have sufficient legal capacity to be bound by these General Conditions of Purchase when contracting any service with CHILL & BUY SL. CHILL & BUY SL reserves the right to cancel or terminate an account in the event of prolonged inactivity. When the customer places their first order, the system will ask for additional personal information to complete the order (shipping and/or billing information). If the customer has previously placed orders, they only need to provide their email address and password on the form. In compliance with the provisions of art. 27.1.c of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), the customer will have technical means at their disposal to identify and correct errors in the entry of personal data. Registered customers will have access to a control panel at all times by entering their username and password. This panel allows them to modify incorrect personal account information, billing information, and shipping information at any time.

MINORS

To place an order, the customer must be at least 18 years old.

MODIFICATION OF THE GENERAL CONDITIONS OF SALE

CHILL & BUY SL reserves the right to modify the general conditions of sale without prior notice, including changing, deleting, or adding content and services provided through the website, as well as the way in which they appear or are located on its servers. These changes must be accepted by the User each time they make a purchase. For this reason, this page should be reviewed frequently or each time a purchase is made. If any clause of these General Conditions of Sale is declared totally or partially null or ineffective, it will only affect the provision or part thereof that is null or ineffective, with the remainder of the general conditions remaining in effect. Such provision or the part thereof that is affected will be deemed not to be included, unless, due to being essential to these general conditions, it must affect them comprehensively.

LEGISLATION

These General Conditions are governed by Spanish law. The parties submit, at their discretion, to the courts and tribunals of the user's domicile for the resolution of disputes and waiving any other jurisdiction.
